   1.2. These Website Terms and Conditions (“Terms and Conditions”) regulate the ordering, sale and delivery of goods, and the use of the Website.
   1.3. You are granted a limited license only for purposes of viewing the material contained on this Website.
   1.4. These Terms and Conditions are binding and enforceable against every person that accesses or uses this Website (“you”, “your” or “user”). By using the Website and/or by clicking on the relevant box on the Website, as may be applicable, you acknowledge that you have read and agree to be bound by these Terms and Conditions.
   1.5. If you are under the age of 18, you must obtain your parents’ or legal guardians’ advance authorisation, permission and consent to be bound by these Terms and Conditions before purchasing any products or services.

   4.1. The use of the Website is entirely at your own risk and you assume full responsibility for any risk or loss resulting from use of the Website or reliance on any information on the Website.
   4.2. Whilst Eddy Ferro Decor takes reasonable measures to ensure that the content of the Website is accurate and complete, Eddy Ferro Decor makes no representations or warranties, whether express or implied, as to the quality, timeliness, operation, integrity, availability or functionality of the Website or as to the accuracy, completeness or reliability of any information on the Website.
   4.3. Eddy Ferro Decor repudiates liability for any damage, loss or expenses, whether direct, indirect or consequential in nature, arising out of or in connection with your access to or use of the Website and/or any content therein unless otherwise provided by law.
   4.4. Although Goods sold from the Website may, under certain specifically defined circumstances, be under a supplier’s warranty, the Website itself and all information provided on the Website is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, completeness, or non-infringement, as may be allowed in law.

In addition to the disclaimers contained elsewhere in these Terms and Conditions, Eddy Ferro Decor also makes no warranty or representation, whether express or implied, that the information or files available on the Website are free of viruses, spyware, malware, trojans, destructive materials or any other data or code which is able to corrupt, destroy, compromise, disrupt, disable, harm, jeopardise or otherwise impede in any manner the operation, stability, security functionality or content of your computer system, computer network, hardware or software in any way. You accept all risk associated with the existence of such viruses, destructive materials or any other data or code which is able to corrupt, compromise, jeopardise, disrupt, disable, harm or otherwise impede in any manner the operation or content of a computer system, computer network, any handset or mobile device, or your hardware or software, save where such risks arise due to the gross negligence or wilful misconduct of Eddy Ferro Decor, its employees, agents or authorised representatives.

   5.1. This Website may provide links or references to other websites (“Third Party Websites”) which are outside of our control, including those of advertisers. These Terms and Conditions do not apply to those Third-Party Websites and Eddy Ferro Decor is not responsible for the practices and/or privacy policies of those Third Party Websites or the “cookies” that those sites may use.

Notwithstanding the fact that the Website may refer to or provide links to Third Party Websites, your use of such Third Party Websites is entirely at your own risk and we are not responsible for any loss, expense, claim or damage, whether direct, indirect or consequential, arising from your use of such Third Party Websites or your reliance on any information contained thereon.

6. Returns
   6.1. Please refer to our Returns Policy for more information about returning products (and related refunds, replacements or repairs). The Returns Policy is incorporated by reference (which means that it forms part of these Terms and Conditions).

7. Use of the website
   7.1. Only users may order Goods on the Website.
   7.2. To purchase goods as a user, you may:
   7.2.1. Make a payment as a guest. This will require you to fill in your personal details every time a purchase is made on the website; or
   7.2.2. Sign up as a registered user allowing you easy access to the online portal. Upon registration you will be required to provide your first name, last name, email address and password.
   7.3. You agree and warrant that your details and password shall:
   7.3.1. be used for personal use only; and
   7.3.2. not be disclosed by you to any third party.
   7.4. Eddy Ferro Decor will not be held responsible for any misuse or loss of your password.
   7.5. Once the correct details and password relating to your account have been entered, irrespective of whether the use of the details and password is unauthorised or fraudulent, you will be liable for payment of such order, save where the order is cancelled by you in accordance with these Terms and Conditions.
   7.6. You agree to notify Eddy Ferro Decor immediately upon becoming aware of or reasonably suspecting any unauthorised access to or use of your details and password and to take steps to mitigate any resultant loss or harm.
   7.7. By using the Website you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use the Website only with the involvement and supervision of your parent or legal guardian. If your parent or legal guardian supervises you and gives his/her consent, then such person agrees to be bound to these Terms and Conditions and to be liable and responsible for you and all your obligations under these Terms and Conditions.
   7.8. You agree that you will not in any way use any device, software or other instrument to interfere or attempt to interfere with the proper working of the Website.

8. Conclusion of sales and availability of stock
   8.1. Users may place orders for Goods, which Eddy Ferro Decor may accept or reject. Acceptance of an order depends on the availability of goods, correctness of the information relating to the goods (including, without limitation, the price) and receipt of payment or payment authorisation.
   8.2. Eddy Ferro Decor will indicate the acceptance of your order by delivering the goods to you and only at that point will an agreement of sale between you and Eddy Ferro Decor come into effect (the “Sale”). The latter is regardless of any communication from Eddy Ferro Decor stating that your order or payment has been confirmed. Eddy Ferro Decor will indicate the rejection of your order by cancelling it and, as soon as possible thereafter, refunding you for any amount already paid.

9. Payment
   9.1. Eddy Ferro Decor shall provide secure online payment facilities.
   9.2. Once you have selected your payment, you will be directed to a link to a secure site for payment of the applicable purchase price for the Goods.
   9.3. Eddy Ferro Decor shall not be liable for any loss, claim or expense relating to a failed online payment transaction, unless such loss is caused due to the gross negligence of Eddy Ferro Decor.

10. Discounts
    10.1. Only one discount code may be used per purchase and cannot be reused by the same user more than once.

11. Delivery of goods
    11.1. Eddy Ferro Decor offers delivery via courier.
    11.2. Where it accepts your order, Eddy Ferro Decor will deliver the goods to you as soon as reasonably possible, but no later than 30 (thirty) business days after receipt of your payment (“Delivery Period”).
    11.3. Eddy Ferro Decor will not deliver goods to PO Box addresses.
    11.4. If the courier is unable to deliver the goods at the address provided by the user, the courier will attempt contacting the customer twice whereafter the goods will be returned to Eddy Ferro Decor.
    11.5. If the courier attempts to deliver the goods to your address unsuccessfully more than 2 (two) times, your order will be cancelled, and you will be charged a penalty fee at the discretion of Eddy Ferro Decor.
    11.6. Eddy Ferro Decor’s obligation to deliver a product to you is fulfilled when the product is delivered to the physical address nominated by you for delivery of the order. Eddy Ferro Decor is not responsible for any loss or unauthorised use of a product, after it has delivered the product to the physical address nominated by you.

11.7. Should your order be lost or damaged during transit, Eddy Ferro Decor does not take responsibility for such loss or damage once a product has been handed over to the third-party courier service.

12. Errors
    12.1. Eddy Ferro Decor shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges of Goods on the Website.
    12.2. However, should there be any errors of whatsoever nature on the Website, which are not due to our gross negligence, we shall not be liable for any loss, claim or expense relating to a transaction based on any error, save – in the case of any incorrect purchase price – to the extent of refunding you for any amount already paid, or otherwise as set out in the Returns Policy.
    12.3. Eddy Ferro Decor shall not be bound by any incorrect information regarding our Goods displayed on any third-party websites.

13. Privacy policy
    13.1. Please refer to our Privacy Policy for more information. The Privacy Policy is incorporated by reference (which means that it forms part of these Terms and Conditions).

14. Changes to these Terms and Conditions
    14.1. Eddy Ferro Decor may, in its sole discretion, change any of these Terms and Conditions at any time. It is your responsibility to regularly check these Terms and Conditions and make sure that you are satisfied with the changes. Should you not be satisfied, you must not place any further orders on, or in any other way use, the Website.
    14.2. Any such change will only apply to your use of this Website after the change is displayed on the Website. If you use the Website after such amended Terms and Conditions have been displayed on the Website, you will be deemed to have accepted such changes.

15. Electronic communications
    15.1. When you visit the Website or send emails to Eddy Ferro Decor, you consent to receive communications from us or any of our divisions, affiliates or partners electronically.

16. Limitation of liability
    16.1. Eddy Ferro Decor will not be held liable for any inaccurate information published on the Website and/or any incorrect prices displayed on the Website, save where such liability arises from the gross negligence or wilful misconduct of EDDY FERRO DECOR, its employees, agents or authorised representatives.
    16.2. Eddy Ferro Decor shall not be liable for any direct, indirect, incidental, special or consequential loss or damages which might arise from your use of, or reliance upon, the website or the content contained in the website; or your inability to use the website, and/or unlawful activity on the website.
    16.3. You hereby indemnify Eddy Ferro Decor against any loss, claim or damage which may be suffered by yourself or any third party arising in any way from your use of this website and/or any linked Third-Party website.

17. Governing law and jurisdiction
    17.1. These Terms and Conditions and our relationship and/or any dispute arising from or in connection with these Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa.

    18.2. You hereby select the delivery address specified with your order as your legal address, but you may change it to any other physical address by giving Eddy Ferro Decor notice within 24 (twenty four) hours after placing the order and/or before delivery.
    18.3. Notices must be sent via email to hello@eddyferro.com and must be in English.
    18.3.1. All notices will be deemed to have been sent on the date indicated in the “Read Receipt” notification. All email communications between you and Eddy Ferro Decor must make use of the “read receipt” function to serve as proof that an email has been received.

20. General
    20.1. Eddy Ferro Decor may, in its sole discretion, at any time and for any reason and without prior written notice, suspend or terminate the operation of the Website or the user’s right to use the Website or any of its contents subject to us processing any orders then already made by you.
    20.1.1. You may not cede, assign or otherwise transfer your rights and obligations in terms of these Terms and Conditions to any third party.
    20.1.2. Any failure on the part of you or Eddy Ferro Decor to enforce any right in terms hereof shall not constitute a waiver of that right.
    20.1.3. If any term or condition contained herein is declared invalid, the remaining terms and conditions will remain in full force and effect.
    20.1.4. No variation, addition, deletion, or agreed cancellation of the Terms and Conditions will be of any force or effect unless in writing and accepted by or on behalf of the parties hereto.
    20.1.5. No indulgence, extension of time, relaxation or latitude which any party (the “grantor”) may show grant or allow to the other (the “grantee”) shall constitute a waiver by the grantor of any of the grantor’s rights and the grantor shall not thereby be prejudiced or stopped from exercising any of its rights against the grantee which may have arisen in the past or which might arise in the future.
    20.1.6. These Terms and Conditions contain the whole agreement between you and Eddy Ferro Decor and no other warranty or undertaking is valid, unless contained in this document between the parties.

If you are not completely satisfied with your purchase, you can return the product to us and we will replace it or provide you with store credit, subject to the terms below.
This policy forms part of the Eddy Ferro Decor Website Terms and Conditions and the words defined in the Terms and Conditions have the same meaning in this policy unless the context indicates otherwise. Nothing in this policy is intended to limit your statutory rights in any way.

1. Unwanted Products
   1.1. In general, you can return an unwanted product to us, provided that:
   1.1.1. it is undamaged and unused, with the original labels and stickers still attached;
   1.1.2. it is in the original packaging, which must be undamaged and in its original condition with all seals still intact (if applicable);
   1.1.3. it is not missing any accessories or parts;
   1.1.4. it is not listed in section 2 – Products not eligible for return; and
   1.1.5. you log a return via orders@eddyferro.com within 24 hours of delivery to you of the unwanted product.
   1.2. Please retain your invoice of the purchase as well as proof of receipt of the product provided by the courier.
   1.3. We will collect the product from you:
   1.3.1. at no cost if the product is defective; and
   1.3.2. at your cost if it is an unwanted product.
   1.4. Our courier is entitled to refuse collection of a product that is not properly packaged for transport.
   1.5. Once we have inspected the product and validated your return, we will provide you with a store credit of the purchase price within 7 business days of the return.
   1.6. If we accidentally deliver the wrong product to you, please notify us within 24 hours of receiving the product and we will collect the product from you at no charge. Once we have inspected the product and validated your return, we will deliver the correct product to you as soon as possible.

2. Products not eligible for returns
   2.1. The following products are not eligible for a refund, exchange or credit:
   2.1.1. electronic vouchers;
   2.1.2. for hygienic reasons, any product which has been used after purchase; or
   2.1.3. products which have been personalised for you or made to your specifications, unless defective.
3. Discounted items or items on sale

3. Products damaged on delivery
   3.1. Should a product be damaged at the time of delivery, please notify us of such delivery via email on orders@eddyferro.com within 24 hours after receipt.
   3.2. Eddy Ferro Decor cannot take responsibility of the damaged items if you fail to give notice as per 3.1 above.
   3.3. Eddy Ferro Decor will arrange to collect the product from you at no charge. Once we have inspected the product and validated your return, we will replace the product as soon as possible.

4. Defective products
   4.1. The following will not be regarded as defects and will not entitle you to a return under this section:
   4.1.1. faults resulting from normal wear and tear;
   4.1.2. damage arising from negligence, user abuse or incorrect usage of the product;
   4.1.3. damage arising from electrical surges or sea air corrosion;
   4.1.4. damage arising from a failure to adequately care for the product;
   4.1.5. damage arising from unauthorised alterations to the product; and
   4.1.6. where the specifications of a product, although accurately described on the Website and generally fit for its intended purpose, do not suit you.

5. Standard Warranty
   5.1. If you have received a product which turns out to be defective, please notify us as soon as reasonably possible after you become aware of the defect, but in any event within 6 months after delivery of the product.
   5.2. You can do so by logging a return via orders@eddyferro.com, and we will arrange to collect the product from you. Once we have inspected the product and validated your return, we will replace the product. Replacements can take 5-10 business days, depending on parts / replacement availability.
   5.3. Please provide suitable packaging for returning the product (it need not be the original packaging), as well as all accessories that were sold with the defective item when you return it to us. Our courier is entitled to refuse collection of a product that is not properly packaged for transport.

5.4. Extended Supplier Warranty
5.4.1. A product may have a supplier warranty that extends beyond the 6 months. If such a product turns out to be defective more than 6 months after delivery, please notify us as soon as reasonably possible after you become aware of the defect, but in any event within the extended supplier warranty period after delivery of the product.
5.4.2. You can do so by logging a return via orders@eddyferro.com, and we will facilitate your return of the product to the supplier at no charge.
5.4.3. Please note that any extended supplier warranty is subject to whatever terms and conditions the supplier or manufacturer may impose. These are usually stated in a brochure or leaflet inside or on the product packaging. It is your responsibility to make yourself aware of any such terms and conditions.
5.4.4. Please provide suitable packaging for returning the product, as well as all accessories that were sold with the defective item when you return it to us. Our courier reserves the right to refuse collection of a product that is not properly packaged for transport.
5.4.5. It is also important to note that we are under no obligation to provide you with a store credit or replacement for any return logged after six months, as your remedy lies with the supplier or manufacturer.

6. Charges
   6.1. If you return a defective product to us, but you fail to return all of the accessories that were sold with that product, we are entitled to refuse the return, only to replace the item that you did return, or to estimate the value of the missing accessories and only to credit you in respect of the returned item.
   6.2. If you return items to us by mistake and you want these returned to you, you may be liable to reimburse us for the cost of having the product returned to you.
   6.3. If you return a product that does not comply with this policy, you may be liable to reimburse us for the cost of collecting the product from you and the cost of having the product returned to you.

   6.1.1 in relation to the ordering, sale and delivery of Goods;
   6.1.2 to contact you regarding current or new Goods or services or any other goods offered by us or any of our divisions, affiliates and/or partners (unless you have opted out from receiving marketing material from us);
   6.1.3 to inform you of new features, special offers and promotional competitions offered by us or any of our divisions, affiliates and/or partners (unless you have opted out from receiving marketing material from us); and
   6.1.4 to improve our product selection and your experience on our Website by, for example, monitoring your browsing habits, or tracking your sales on the Website; or
   6.2 disclose your personal information to any third party other than as set out below:
   6.2.1 to our employees and/or third party service providers who assist us to interact with you via our Website, email or any other method, for the ordering of Goods or when delivering Goods to you, and thus need to know your personal information in order to assist us to communicate with you properly and efficiently;
   6.2.2 to our divisions, affiliates and/or partners (including their employees and/or third party service providers) in order for them to interact directly with you via email or any other method for purposes of sending you marketing material regarding any current or new goods or services, new features, special offers or promotional items offered by them (unless you have opted out from receiving marketing material from us);
   6.2.3 to law enforcement, government officials, fraud detection agencies or other third parties when we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report or support the investigation into suspected illegal activity, or to investigate violations of these Terms and Conditions; and

However, our contracts dictate that these service providers may only use your information in connection with the services they perform for us and not for their own benefit.

We are entitled to use or disclose your personal information if such use or disclosure is required in order to comply with any applicable law, subpoena, order of court or legal process served on us, or to protect and defend our rights or property. In the event of a fraudulent online payment, Eddy Ferro Decor is entitled to disclose relevant personal information for criminal investigation purposes or in line with any other legal obligation for disclosure of the personal information which may be required of it.

We will ensure that all our employees, third party service providers, divisions, affiliates and partners (including their employees and third-party service providers) having access to your personal information are bound by appropriate and legally binding confidentiality obligations in relation to your personal information.

When you provide a rating or review of a Product, you consent to us using that rating or review as we deem fit, including without limitation on the Website, in newsletters or other marketing material. We will not display your Last Name, nor any of your contact details, with a rating or review.
   10. We will –
   10.1 treat your personal information as strictly confidential, save where we are entitled to share it as set out in this policy;
   10.2 take appropriate technical and organisational measures to ensure that your personal information is kept secure and is protected against unauthorised or unlawful processing, accidental loss, destruction or damage, alteration, disclosure or access;
